1. Agreement to Terms

Welcome to QuiltPlannerPro, operated by T Top Quilts LLC ("Company," "we," "our," or "us"). By accessing or using our website at www.quiltplannerpro.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years old to use this Service. By using QuiltPlannerPro, you represent and warrant that you are at least 18 years of age.

2. Description of Service

QuiltPlannerPro is an AI-powered software platform that generates custom quilt patterns based on fabric images you upload. Our Service:

Allows you to upload images of your fabric
Generates personalized quilt patterns using artificial intelligence
Provides downloadable pattern files in various formats
Offers different subscription tiers with varying usage limits

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account by providing:

A valid email address
A secure password
Accurate account information

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We reserve the right to terminate accounts that violate these Terms or remain inactive for extended periods.

3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent usage limits or other restrictions is prohibited.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer multiple subscription tiers (Free, Hobbyist, Enthusiast, Pro) with different features and usage limits. Current pricing and features are available on our Pricing page.

4.2 Payment

Subscriptions are billed monthly or annually in advance
Payments are processed securely through our third-party payment processor, Stripe
All fees are in U.S. Dollars (USD)
You authorize us to charge your payment method for all fees

4.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the then-current subscription rate.

4.4 Subscription Changes

You may cancel, downgrade, or upgrade your subscription at any time through your account settings or by contacting support@quiltplannerpro.com.

All subscription changes take effect at your next billing cycle:

You retain access to your current subscription tier and features until the end of your current billing period
Changes apply on your next billing date
Cancellation: Your subscription will not renew; your account reverts to the Free tier at the start of the next billing cycle
Downgrade: You are charged the new lower rate starting the next billing cycle; tier features change at that time
Upgrade: You are charged the new higher rate starting the next billing cycle; tier features change at that time

No refunds are provided for:

Partial months of service
Unused portions of your subscription
The difference in cost when downgrading during the current billing period

4.5 Changes to Pricing

We reserve the right to modify subscription pricing with 30 days' notice to existing subscribers. Price changes will not affect your current billing period.

5. Usage Limits and Restrictions

5.1 Fair Use

Each subscription tier includes specific usage limits (number of patterns generated per month). These limits reset on the first day of each calendar month.

5.2 Prohibited Uses

You agree NOT to:

Use the Service for any illegal purpose
Upload images you do not have rights to use
Attempt to reverse engineer or copy our AI technology
Use automated tools, bots, or scripts to access the Service
Resell, redistribute, or sublicense access to the Service
Share your account credentials with others
Circumvent usage limits through multiple accounts
Use the Service to generate patterns for resale or redistribution
Attempt to interfere with or disrupt the Service

5.3 Enforcement

We reserve the right to suspend or terminate accounts that violate usage limits or restrictions, with or without notice.

6. Intellectual Property Rights

6.1 Your Content (Fabric Images)

You retain all ownership rights to the fabric images you upload
You grant us a limited, non-exclusive license to process your images solely to generate patterns
We do not store your fabric images beyond the duration of your session
You represent that you have the right to use any images you upload

6.2 Generated Patterns

AI-generated quilt patterns created through our Service are provided to you for your personal and commercial use
You MAY: Use patterns to create quilts for personal use, as gifts, or to sell finished quilts made from the patterns
You MAY NOT: Resell, redistribute, sublicense, or commercially distribute the pattern files themselves
Patterns are provided "as-is" without warranty of accuracy, functionality, or suitability

6.3 Our Intellectual Property

The Service, including its design, code, algorithms, branding, and content (excluding your uploaded images and generated patterns), is owned by T Top Quilts LLC and protected by copyright, trademark, and other intellectual property laws.

7. Content and Conduct

7.1 User Responsibility

You are solely responsible for:

The legality and appropriateness of images you upload
Ensuring you have rights to any fabric designs in your images
The accuracy of measurements and instructions in generated patterns
The quality and outcome of any quilts you create using our patterns

7.2 Prohibited Content

You may not upload images that:

Infringe on intellectual property rights of others
Contain illegal, offensive, or inappropriate content
Violate any applicable laws or regulations

8. Disclaimers and Limitations of Liability

8.1 Service Provided "As-Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will be uninterrupted or error-free
Warranties regarding the accuracy or reliability of generated patterns

8.2 AI-Generated Content Disclaimer

Patterns are generated using artificial intelligence technology. While we strive for quality:

Patterns may contain errors or imperfections
Pattern complexity may not always match user skill level perfectly
Fabric measurements and calculations should be independently verified
We are not responsible for fabric waste, incorrect cuts, or project failures

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, T TOP QUILTS LLC SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Damages resulting from your use or inability to use the Service
Damages resulting from errors in generated patterns
Any amount exceeding the fees you paid in the 12 months before the claim

8.4 User Assumption of Risk

You acknowledge that quilting involves measuring, cutting, and sewing fabric, and you assume all risks associated with using our patterns. Always verify measurements and suitability before cutting fabric.

9. Indemnification

You agree to indemnify, defend, and hold harmless T Top Quilts LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another person or entity
Content you upload to the Service

10. Third-Party Services

Our Service integrates with third-party services including:

Stripe for payment processing
Anthropic Claude for AI pattern generation
Email service providers for transactional emails

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy (available at www.quiltplannerpro.com/privacy) to understand how we collect, use, and protect your information.

12. Modifications to Service and Terms

12.1 Service Changes

We reserve the right to:

Modify, suspend, or discontinue any part of the Service
Change features or functionality
Impose new limits on usage

We will provide reasonable notice of material changes when possible.

12.2 Terms Updates

We may update these Terms from time to time. When we do:

We will update the "Last Updated" date
Material changes will be communicated via email or Service notification
Continued use of the Service after changes constitutes acceptance

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

Canceling your subscription through account settings
Contacting us at support@quiltplannerpro.com
No refunds will be provided for early termination

13.2 Termination by Us

We may suspend or terminate your account immediately if:

You violate these Terms
You engage in fraudulent activity
Your account remains inactive for an extended period
Required by law

13.3 Effect of Termination

Upon termination:

Your right to use the Service immediately ceases
We will delete your account data within 30 days
You may lose access to previously generated patterns unless downloaded
Sections of these Terms that should survive (indemnification, disclaimers, etc.) will continue to apply

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any legal claim, you agree to contact us at support@quiltplannerpro.com to attempt to resolve the dispute informally. We'll work in good faith to reach a resolution.

14.3 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Maryland, and you consent to personal jurisdiction in those courts.

14.4 No Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14.5 Time Limit for Claims

You must bring any claims within one (1) year after the claim arises, or the claim is permanently barred.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and T Top Quilts LLC regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, labor disputes, or service outages.

15.6 Export Controls

You agree to comply with all applicable export and import control laws and regulations.

17. Acknowledgment

BY USING QUILTPLANNERPRO, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
